In North America, names are dissociated from their terroirs. Place, people and Know How are irrelevant. Parmesan is some kind of grated cheese sold by Kraft in my store next door in Montréal. Champagne I sparkling white wine. Who cares if it is good? Modern Utilitarian of the Free World vs. Old Europe Imperialism?
Article 20.16 ff – Comprehensive Economic and Trade Agreement
Lezione 15 – 4.5 On en a « MAR » – Making Available Right and Fair Dealing New Exception: Technical or Cultural Issues ?
The Canadian Supreme Court heard two very technical cases dealing with copyright matters. The first one concerns the implementation of the making available right (MAR). Is MAR a self-standing, independent right which could be managed be Collective societies in addition to the right of reproduction? Some say answering positively to this question would create an additional “tax”. The second one concerns the new fair dealing exception for “education” purposes. We will discuss, with prof. Caso, expert on this question, whether the removal of Copyright in the field of education is a good thing!
