Abstract
Teachers who use the problem-based approach to teach Intellectual Property (IP) Law face two challenges:
a) distinguishing between outputs generated by Artificial Intelligence (AI) and those resulting from human learning;
b) teaching students that the use of generative AI within the course must first address the question of who produces and distributes generative AI software, as well as the potential and, above all, the limitations in formulating and resolving legal problems drawn from IP cases.
The first challenge can be addressed by complementing the production of written assignments with extensive oral discussions based on the maieutic method.
The second challenge can be addressed by encouraging students to ask themselves who governs generative AI and by carrying out exercises based on a comparison between problems and solutions formulated by people and those formulated by various generative AI software programmes.
